Depends on the application, suing for $ in civil court for constitutional right violations is not the same as challenging the "law". It merely represents a penalty for rights in liberty that were previously accessible to have been unconstitutionaly revoked.

I think a class action lawsuit is the best bet on constitutional grounds.
