    Best insurance to guard against excessive smoke is good, clean #2 diesel fuel and a light throttle foot. The biggest problem with wording in this (or any) statute is that there's a wide avenue for interpretation. Just how much smoke is excessive smoke? Not too many LEOs I know carry Ringelmann...
