Is this HMMWV leagal

First off, I'm a new member here. I was a Army MP from1971 to 1973. I presently am the proud owner of a 1995 Gas wagon. A customer of mine has this HMMWV that seems to be a 1985 era M1038. He bought it in 2007 in a auction. The bill of sales from the auction co. states it came from a county sheriffs office and all this info is listed on the bill of sale. It could be that this sheriffs office had the right to put it up for sale but then again it may not have had that right. This truck only has 6,600 miles and I'm chumping at the bit to get it. So How do I know if I can legally own this great truck.

The sheriff must maitain possesion for 1 year, then they are free to sell, auction, or dispose of as they see fit.

If it doesnt have a title and you plan on driving it on the road walk away to much bs to get a title!!!:deadhorse:

Heck mine had a title and It still took some 3 years and jumping counties to get a tag for it. don't sweat it not having a title. Let me back up, it depends on what state your in. some are easier than others but I'd still buy it. Most states could care less about a title bc they are getting so old.

This is only true for vehicles that do not require DEMIL. HMMWV's have further restrictions.

My understanding is that LE agencies that get HMMWV's must either return them when finished or DEMIL them.

Some of you guys need to get a grip. Once and for all, IT DEPENDS UPON THE STATE. A Sheriff's department vehicle is not required to have a title in some states and upon the legitimate sale, can then be issued a title. Ohio, Georgia and Colorado are this way.

Try looking on your state DMV website and see what info you can find there. I checked mine here and when I went to DMV to register my 813 and they gave me flak I was able to direct them to their website and why and how to register my vehicle. A lot of DMVs do not have experiance with these vehicle and if you go in to them well informed you have a better chance of getting it done the first time.

It has never been titled, I probably could get it titled in Louisiana. I'm just worried that my good ole Uncle Sam could take it back someday.
I don't think I would worry about uncle sam too much if it was auctioned for a sheriffs dept.

I also don't think I would rely heavily on what any of us say here about registration/titling issues.

My best advise is to get all the info you can on the hummer...vin, mfgr dates etc, whatever paper trail you can establish and take all that to your DMV.
THEY will be the deciding factor...not anyone on here.

Otherwise...you may end up with a nice vehicle that can't leave the driveway or farm etc.

P.S....I mean no disrespect to anyone on here or their opinions.

I concur with B3.3T, you guys really need to get to know the law a little better. If the truck was seconded down to the Sheriff's Department, very likely either the state surplus property officer or the State LE Property officer acquired the truck from Uncle Sam. The way that works is Uncle sells the affected agency the truck or other property for a paperwork fee, usually quite minimal. The requirement is that the acquiring agency hold the property, usually for two to three years, then they can dispose of it any way they want.
As military equipment it NEVER had a title, it was purchased by Uncle on a Government Purchase Contract, and equipment so purchased doesn't have a title as Uncle doesn't need a title, his powers in these matters exceeds the state jurisdiction. Likely the Sheriff never needed a title either as it was a government to government agency transfer of property, nothing more, nothing less. NOW if the OP has a legitimate bill of sale from the Sheriff with the SN and such data on it, there are probably only a few states anal enough to not recognize a Government bill of sale, so the title should go through no different then any other cop car sale.
As a footnote, a City I lived in once turned down for $300.00 paperwork fees a rebuilt GE 44 Ton Diesel Electric Switch engine (locomotive) form the USAF through State Surplus.... All the puppies had to do was hold it two years and sell, in the meantime my RR museum could have used it for a shop switcher, now the locomotive would be worth 30 or 40K$.... So set up a non-profit museum and you too can join the game.....
