MV Mounted Gun Laws

Anyone know about or where to find gun laws for displaying active weapons auto or semi auto on a military vehicle for show or parade? Just curious as I've seen one real 1919a4 and one 1917a1 displayed on jeeps. One guy said he had his NFA papers with him but, I'm not sure it is still legal?

As long as it's unloaded, I think it's legal in most states. It could cause a bunch of unwanted attention though if you do something like go to the bank to cash your paycheck with the weapon mounted (even if it's not real).

A ccw license has no bearing whatsoever on displaying weapons on a vehicle in plain sight. For an eye-opener and a chuckle, read the thread about the gun truck that was in Virginia (I think) and was only a relatively short distance away from Biden's motorcade. Luckily they were going the opposite direction.

Sad fact: if you have in your medical record any mention of post traumatic stress you lose your right to own guns in many states. Be the PST from a combat condition or car accident once you are labeled no ownership

All depends on your location, any response will be largely vague.

NFA Firearms are regulated in Federal level BUT they can clash with your State/County regulations, you must obey both.

Don't take the Internet opinions on that, call your Local ATF Office and find out the Federal level regulations for your area and also call your local Sheriff Dept to find out about any local regulation or restriction.

I myself always send a letter so I will have their response in a signed piece of paper, whatever you do, get it well documented as most COP's know very little about NFA Firearms Regulations.

Having a CCW has nothing to do with displaying a weapon in plain sight.

And what states do not allow soldiers returning from combat with PTSD to own firearms???? A medical condition does not supercede the 2nd amendment. I live in NC, I have been diagnosed with PTSD, and I have multiple firearms. I have even purchased firearms since being diagnosed with PTSD.

I am a soldier and former law enforcement officer, and I have never heard of this. Where are you getting this information from???

I've wondered myself if it would be legal to have a rifle or MG or even a dummy on a deuce in a parade. I don't believe it would be legal in MN. Maybe in states like Texas where you can carry a rifle in your truck in a rack, but here it would have to be cased and in the farther-est area of the vehicle/not accessible.

If you are a member of the USCCA you can get a list of lawyers that specialize in gun laws. Anything else and it is hearsay and speculation.

As for PTSD it might be considered a disability that would disqualify you from purchasing a firearm but the above still applies.

We have a local guy who carries his 30Cal machine gun on his Jeep in parades.

Michigan is an open carry State also. A cpl allows you to carry just about every where.

A lot of it boils down to the individual states. In CT, the law revolves more around intent. I have airsoft M60's on my M37. If I were to remove one, and point it at someone in a threatening manner, I could be in violation of the law. Since I started taking my guntruck to local shows earlier this year, I've had the attention of numerous LEOs. I've done parades, too, and the local LEOs always seem to smile when I pass by. I've talked with many of them and the common thread is that if you act responsibly and don't joy ride with the weapons displayed, everything is fine. That doesn't mean that some day a LEO with a hair across his butt won't try to make things into something they're not, but for the most part they realize it's for show and in this state, the MV guys have good reps as responsible people. As always, YMMV.

Bingo. There's what's LEGAL, and there's what some local PD has decided they will permit.

Our law in Virginia is crystal clear - local governments have NO authority to regulate the carry of weapons. Still, we had a person arrested TWICE in Newport News last year, because that town decided they weren't going to allow open carry.

Of course, they got it shoved up their backsides as soon as it went to court, but the guy was still arrested, handcuffed, and jailed. I think they've backed off now since they had to pay a bit of money for being jack-booted thugs and spitting on the law, but still, you have to decide how much hassle you are willing to endure.

In some jurisdictions, displaying a replica will get you arrested for disturbing the peace.

The best advice has already been given - check with your local law enforcement.

I'm up in Bemidji, and talked to a gentleman who has an M37 and several Jeeps that run in our 4th of July Parade every year. This past year, he ran his new Jeep, with MG mount empty (He left the semi Ma Deuce at home). The Sheriff asked why the MG mount was empty, and the gentleman said he didn't want to get in any trouble. The Sheriff said that if he brought his Jeep next year WITH OUT the Ma Deuce, then he'd be in real trouble

Bottom line - call your local LEO before deciding what to do.

As far as the actual "law" on the subject, I can't be of much help other than to agree with those who have said to check with your local LEO to see what they will allow...and why or why not.

In our case, we usually dismount the 50's and 60's etc., until we get where we are going to prevent some "well meaning" person calling in and complaining. This includes movement to Veterans Day Parades etc., unless we have a police escort enroute to the start point...and we usually do.

Around here, even the active duty military vehicles normally do not have weapons mounted when moving around in civilian terrain unless they are on a specific training mission/display etc.

I think the key here is first, check with the LEOs to see what they will NOT permit and then the rest is just common sense.

I had a Ma Duece (simulated fire) mounted on a trailer that I was pulling behind my civilian car. Got pulled over and had to remain in my car until backup arrived.
As one guy was checking out the 50cal. The other asked if I had any other weapons and I showed him my mp5 and paperwork.

The initial guy who pulled me over was a national guardsman that repairs 50s and recognized the shape under the tarp and was curious about the gas hoses.

I drive my ferret with 30 cal dummy in the turret and a minigun mounted on top and have not been questioned. I do pull the guns if I do a school event.

I went up to the courthouse to update my firearms carry license, which is not really required to carry in Georgia, other than concealed, and was shocked at the price to update, where prices had risen dramatically. When I asked questions, I was a little surprised they had a preprinted link to answer all questions on the NRA website and it was given to me.

In any case, it varies state by state. When in doubt, do your own research. Even LEO's don't have all the answers, and I have previously been given a lot of different "opinions" from LEO's on what is legal and what is not. So it is always a good idea to ask the local LEO's as well as print out and carry the state's laws with you, in case you are questioned by a LEO, at least you have a reasonable explanation in case it doesn't agree with his interpretation. Here is a link where you can start your research. You don't want to be caught anywhere in the U.S. with an automatic and not have the appropriate Federal papers. Semi-autos and pistols are different and general purpose state laws are written for them.

By the way, 5 years ago, I could not legally store a pistol in my glove box as it was considered concealed in Georgia law. That has since been changed, and today, I can, and without a gun permit. Point is, these laws change regularly so be sure to check each and every year for the laws applicable to you in your State.

Ooops. Sorry. My intent was only to point out that knowing the letter of the law isn't always enough, as local PDs sometimes have different ideas.

We've had our .50 [replica] out 3 times and so far so good. We did make a solid orange cap that screws in the barrel for when we take in town [Ocean City] Stopped right next to 3 police officers and they didnt say a word. So far so good.
