The fact that there was a time a few years back that allowed the use of red fuel for road use for a shortage interval is a substantial defense point. For a $1000 fine, I'd get a lawyer.
I've fought these sorts of MV grey area things before and won. Several ways.
What you do is change the law. Sometimes the law supports you in ways you don't expect. The FMCSA folks are VERY clear, our trucks are NOT commercial by virtue of size. It is the use that makes them commercial. I do believe there was a change concerning Recreationally used MVs....though I cannot...

If I get a cop wanting to check my fuel. I'm going to ask for probable cause AND if he has a warrant.
I'm not driving a commercial vehicle. There is no "license" to be checked and if he wants to conduct a criminal investigation on a private citizen then I'm going to stand my ground.

The design is meant to have a LOT of flex and it's a good and practical design. Just a bit old. There's a reason these things rattle and bang when you go over bumps though.
TexAndy, crawl under there and LOOK at the bits and what sits where. The three dog-bones attach the axles to the trunnion for alignment purposes BUT they have flex. In the three link arrangement the springs JSUT provide support and balance. The whole set can pivot under the center trunnion...

No problems either time. Multiple trips while up there around the PA area.
AugDog, Me and my group of Re-enactors/Collectors have imported a few vehicles. You'll need a BATF Form 6 for the importation of an implement of war (which an armored vehicle is).

For the record, unless I was pulling a load that was very small compared to the deuce, I'd not go without brakes over any substantial distance (around a yard or lot) or at any substantial speed (more than low 1st).
On the flip side, I can say that a properly setup deuce with a well connected trailer and good braking system (adjusted brakes, fresh pads well anchored load) works quite well on up to 10,000 lbs on a deuce. I've had my truck and trailer combo right at 26,200 lbs gross combined weight and it...
